Penny, who has been charged with second-degree manslaughter, today (May 21) spoke publicly about the incident for the first time, telling the New York Post that the death of Neely, a 30-year-old homeless street performer, had “nothing to do with race” and all the things to do with “a system that so desperately failed us”.

“I judge a person based on their character. I’m not a white supremacist,” mentioned the previous rifleman within the US Marines.  "Everybody who’s ever met me can tell you, I love all people, I love all cultures.

Compos-Duffy joined in the condemnation of Penny's prosecution, saying: "The Democrat Party runs on racial stress.

"It's very curious how we're coming into an election year they're looking to stoke something that's so obviously is not racial."

The workplace of Manhattan District Attorney Alvin Bragg has charged Penny with second-degree manslaughter and launched him on $100,000 bond.

He didn't enter a plea and his subsequent court docket look is on July 17.
